Speir Pilates Terms of Use

Last updated: September 26, 2026.

Welcome to Speir Pilates. These Terms of Use (available at speirpilates.com/terms-of-use) are a legally binding contract between you and Speir Pilates Holdings, LLC ("Speir," "we," "us," or "our"). They cover your use of our website (speirpilates.com), the Speir Pilates mobile app for iPhone and Android (the "App"), our online booking and purchase pages, and our studios and classes (together, the "Service").

PLEASE READ THESE TERMS CAREFULLY. BY CLICKING "I ACCEPT," BY BOOKING OR PURCHASING A CLASS OR MEMBERSHIP, OR BY DOWNLOADING, INSTALLING, ACCESSING, OR USING THE SERVICE, YOU AGREE THAT YOU HAVE READ AND UNDERSTOOD THESE TERMS AND AGREE TO BE BOUND BY THEM, INCLUDING OUR PRIVACY POLICY (TOGETHER, THESE "TERMS"). OUR PRIVACY POLICY IS AVAILABLE AT SPEIRPILATES.COM/PRIVACY-POLICY AND THROUGH THE "PRIVACY POLICY" LINK IN THE FOOTER OF OUR WEBSITE. IF YOU ARE NOT ELIGIBLE, OR DO NOT AGREE TO THESE TERMS, YOU DO NOT HAVE OUR PERMISSION TO USE THE SERVICE.

ARBITRATION NOTICE: Except for certain kinds of disputes described in Section 18, you agree that disputes arising under these Terms will be resolved by binding, individual arbitration. BY ACCEPTING THESE TERMS, YOU AND SPEIR ARE EACH WAIVING THE RIGHT TO A TRIAL BY JURY OR TO PARTICIPATE IN ANY CLASS ACTION OR REPRESENTATIVE PROCEEDING. YOU AGREE TO GIVE UP YOUR RIGHT TO GO TO COURT to assert or defend your rights under this contract (except for matters that may be taken to small claims court). Your rights will be decided by a NEUTRAL ARBITRATOR and NOT a judge or jury. You may opt out of arbitration within 30 days as described in Section 18.3.

1. The Service

Speir operates reformer Pilates studios in West Hollywood, Ocean Park, Mar Vista, and Newport Beach, California. Through the Service, you can book and take group, trio, and private Pilates classes and personal training sessions, buy memberships and class packs, and manage your account. We may also offer live-streamed or pre-recorded classes from time to time.

2. Health and Safety Disclaimer

YOU SHOULD BE AWARE THAT THERE ARE INHERENT HEALTH RISKS TO EXERCISE, INCLUDING RISK OF INJURY. BY USING THE SERVICE OR TAKING A CLASS, YOU ACKNOWLEDGE AND AGREE THAT YOUR PERFORMANCE OF ANY EXERCISES OR ACTIVITIES, WHETHER IN OUR STUDIOS OR REMOTELY, IS WHOLLY AT YOUR OWN RISK. TO THE FULLEST EXTENT PERMITTED BY LAW, SPEIR, ITS EMPLOYEES, INSTRUCTORS, AND AGENTS WILL NOT BE LIABLE FOR ANY PHYSICAL OR MENTAL INJURY OR ILLNESS THAT MAY RESULT, DIRECTLY OR INDIRECTLY, FROM ANY OF OUR CLASSES. WHILE OUR INSTRUCTORS, DESCRIPTIONS, PICTURES, OR VIDEOS MAY GUIDE YOU ON HOW TO PERFORM EXERCISES, YOU ARE RESPONSIBLE FOR PERFORMING THEM WITH PROPER FORM AND WITHIN YOUR OWN LIMITS, AS RISK OF INJURY INCREASES WITH IMPROPER FORM.

WE STRONGLY RECOMMEND THAT YOU CONSULT A MEDICAL DOCTOR OR OTHER QUALIFIED HEALTH CARE PROFESSIONAL BEFORE STARTING ANY EXERCISE PROGRAM, ESPECIALLY IF YOU ARE PREGNANT OR POSTPARTUM, HAVE ASTHMA, OR HAVE ANY INJURY OR CONDITION THAT MAY AFFECT YOUR BREATHING OR YOUR ABILITY TO EXERCISE SAFELY. PLEASE TELL YOUR INSTRUCTOR ABOUT ANY INJURIES OR PHYSICAL CONSIDERATIONS BEFORE CLASS.

YOU MUST STOP EXERCISING IF YOU FEEL PAIN OR SEVERE DISCOMFORT, AND YOU SHOULD CONSULT A MEDICAL PROFESSIONAL BEFORE RETURNING TO CLASS.

Before your first class, you must sign our liability waiver and release. The waiver is a separate agreement, and nothing in these Terms limits it.

3. Eligibility

You must be at least 18 years old to create an account and agree to these Terms on your own. Clients ages 13 to 17 may use the Service only if a parent or legal guardian agrees to these Terms on their behalf, signs our liability waiver, and is responsible for their use of the Service. The Service is not available to children under 13.

By agreeing to these Terms, you represent that: (a) you meet these age requirements; (b) you have not previously been suspended or removed from the Service; and (c) your registration and use of the Service comply with all applicable laws. If you accept these Terms on behalf of a company or organization, you represent that you have authority to bind it to these Terms.

4. Accounts and Registration

To book classes and use most features of the Service, you must create an account. You agree that the information you provide, such as your name, email address, and phone number, is accurate and that you will keep it up to date. You are responsible for keeping your password confidential and for all activity under your account. If you believe your account is no longer secure, email us right away at hq@speirpilates.com.

You may delete your account at any time. Instructions are in the "How to delete your account" section of our Privacy Policy, available at speirpilates.com/privacy-policy and through the "Privacy Policy" link in the footer of our website.

5. Purchases, Memberships, and Class Credits

5.1 General. Some parts of the Service require payment. Before you pay, you will have the chance to review and accept the price. All prices are in U.S. dollars. Except as stated in these Terms or required by law, all purchases are final and non-refundable.

5.2 Pricing. Our current prices, packages, and fees are posted on the Pricing page of our website and shown at checkout. We may change our prices at any time. If we change the price of a membership you already have, we will give you advance notice before the new price applies, and you may cancel before it takes effect. We may offer promotions with different features or pricing to some clients. A promotion applies only to the people it is offered to and only under its stated terms.

5.3 Payment Authorization. You authorize Speir to charge the payment method on your account for everything you purchase, including applicable taxes. We may pre-authorize your card to confirm it is valid. Payments are processed by our studio management and payment partners, not stored by Speir.

5.4 Memberships and Automatic Renewal. Monthly memberships renew automatically. When you buy a membership, you authorize Speir to charge your payment method each month, on the same date as your first purchase (your "Billing Date"), for the membership fee and applicable taxes, until you cancel. Your membership will continue until you cancel it or we end it. To cancel, email hq@speirpilates.com at least 7 days before your next Billing Date. If you cancel with less than 7 days' notice, you may be charged for one more month. After you cancel, your membership stays active through the end of the month you have already paid for.

5.5 Class Credits. Class packs and some memberships give you class credits ("Credits") that you can use to book classes or sessions. Credits are a limited, personal, non-transferable license to use the Service. They are not cash, have no cash value, cannot be redeemed or exchanged for money, and do not earn interest. Except as required by law, Credits are non-refundable and may not be sold, transferred, gifted, or traded, except as we expressly allow. Any expiration dates for Credits are shown at purchase.

5.6 Late Cancellations and No-Shows. If you cancel a class after the cancellation window or do not show up, you may lose the Credit for that class and may be charged a fee, as described on our Pricing page and at booking. By booking, you authorize us to charge these fees to your payment method.

5.7 Unpaid Amounts. We may suspend or end your access to the Service if any amount you owe is past due. You are also responsible for reasonable fees related to any chargeback or collection of unpaid amounts.

6. Licenses

6.1 Limited License. As long as you follow these Terms, Speir grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license, for your personal, non-commercial use only, to: (a) install and use one copy of the App, obtained from the Apple App Store or Google Play, on a mobile device you own or control; and (b) access and use the Service.

6.2 Restrictions. Except where these restrictions are not allowed by law, you may not: (a) copy, distribute, publicly display, or publicly perform the Service or any class content, including by recording classes; (b) modify the Service; or (c) interfere with or get around any feature of the Service, including any security or access control. If the law prohibits you from using the Service, you may not use it.

6.3 Feedback. If you give us ideas or suggestions about the Service ("Feedback"), you grant Speir an unrestricted, perpetual, irrevocable, non-exclusive, fully paid, royalty-free right to use the Feedback for any purpose, including to improve the Service and create other products and services.

7. Ownership

The Service is owned and operated by Speir. The design, graphics, text, class programming, videos, software, and all other parts of the Service ("Materials") are protected by intellectual property and other laws. All Materials are the property of Speir or its licensors. Except as expressly allowed by Speir, you may not use the Materials. Speir reserves all rights not expressly granted in these Terms.

8. Third-Party Services

8.1 Third-Party Sites and Services. The Service may mention or connect to websites and services we do not own or control, such as payment pages and social media. We are not responsible for their content or practices.

8.2 Third-Party Software. The Service may include open-source software components ("Third-Party Components"). Nothing in these Terms limits your rights under the licenses for those components.

9. User Content

9.1 Generally. Some features of the Service may let you upload or share content, such as reviews, messages, photos, and profile pictures ("User Content"). You keep any ownership rights you have in your User Content.

9.2 License to Speir. By sharing User Content through the Service, you grant Speir a worldwide, non-exclusive, royalty-free, fully paid license (with the right to sublicense) to host, store, transfer, display, perform, reproduce, format, and distribute your User Content, in whole or in part, in any media now known or later developed, in connection with operating and promoting the Service.

9.3 License to Other Users. By sharing User Content with other users of the Service, you grant them a non-exclusive license to access and use it as the Service allows.

9.4 Your Promises. You are solely responsible for your User Content. By sharing User Content, you promise that: (a) you own it or have all rights and permissions needed to grant the licenses in this Section; (b) it does not infringe or violate anyone's intellectual property, privacy, publicity, or other rights, is not defamatory, and does not cause Speir to violate any law; and (c) it is not objectionable, profane, indecent, pornographic, harassing, threatening, hateful, or otherwise inappropriate.

9.5 Our Rights. We do not have to review, edit, or monitor User Content, and we are not responsible for it. We may, at any time and without notice, screen, remove, edit, or block any User Content that we believe violates these Terms or is otherwise objectionable. We do not allow copyright-infringing activity on the Service. You agree to waive any legal or equitable right or remedy you may have against Speir regarding User Content. If we choose to monitor content, we do so in line with our Privacy Policy and take no responsibility for the content.

10. Communications

10.1 Text Messages. Speir and those acting for us may send text (SMS) messages to the phone number you give us. These may include account and booking messages (such as confirmations, reminders, and waitlist alerts) and, if you agree, marketing messages. You can opt out of marketing texts at any time by replying STOP or END, or by emailing hq@speirpilates.com with your phone number and a request to stop marketing texts. You may receive a text confirming your opt-out. Account and booking texts are part of the Service. Agreeing to marketing texts is not a condition of any purchase. Message frequency varies. Message and data rates may apply. Reply HELP for help.

10.2 Push Notifications. If you allow push notifications in the App, we may send you booking reminders, waitlist alerts, and studio updates. You can turn them off anytime in your device settings.

10.3 Email. We may send you emails about your account and bookings, and, if you agree, about our classes, events, and offers. You can opt out of promotional emails by using the unsubscribe option in any promotional email.

11. Studio Conduct and Prohibited Conduct

11.1 In the Studio. Please arrive on time, follow your instructor's directions and posted studio rules, use equipment only as instructed, and treat instructors, staff, and other clients with respect. We may refuse service to, or remove from class, anyone whose conduct is unsafe, disruptive, or violates these Terms.

11.2 Prohibited Conduct. By using the Service, you agree not to:

  • use the Service for any illegal purpose or in violation of any law;
  • harass, threaten, demean, embarrass, or otherwise harm any other client, instructor, or staff member;
  • violate, or encourage others to violate, anyone's rights, including intellectual property rights;
  • interfere with security features of the Service, including by: (a) disabling or getting around features that limit use or copying of content; or (b) reverse engineering or trying to discover the source code of any part of the Service, except where the law expressly allows it;
  • interfere with the operation of the Service or anyone's enjoyment of it, including by: (a) uploading any virus, adware, spyware, or other malicious code; (b) sending unsolicited offers or advertisements to other users; (c) collecting personal information about others without consent; or (d) disrupting any network, equipment, or server used to provide the Service;
  • commit fraud, including impersonating any person, claiming a false affiliation, or accessing another person's account without permission;
  • share your account, or sell or transfer your access to the Service, your Credits, or any Materials, except as we expressly allow; or
  • attempt to do, or help anyone else do, anything described in this Section 11.

12. Changes to These Terms

We may change these Terms from time to time, with at least 7 days' notice before the changes take effect. We will post the updated Terms on this page and change the "Last updated" date. If a change materially affects your rights or obligations, we may ask you to accept the updated Terms to keep using the Service. Material changes take effect when you accept them. Minor changes take effect when posted. Except as allowed in this Section, these Terms may be changed only by a written agreement signed by both parties. Disputes will be decided under the version of these Terms in effect when the dispute arose.

13. Term, Termination, and Changes to the Service

13.1 Term. These Terms start when you accept them or first use the Service, and continue until ended as described in Section 13.2.

13.2 Termination. If you violate these Terms, your right to use the Service ends automatically. Speir may also suspend or end your account or access to the Service at any time, for any reason or no reason, with or without notice, to the extent permitted by law. You may close your account and end these Terms at any time by emailing hq@speirpilates.com or by deleting your account in the App.

13.3 Effect of Termination. When these Terms end: (a) your licenses end and you must stop using the Service; (b) you will no longer have access to your account; (c) you must pay any amounts owed before termination; and (d) all payment obligations that arose before termination, and Sections 6.3, 7, 13.3, 14, 15, 16, 17, 18, and 19 will continue to apply.

13.4 Changes to the Service. We may change, limit, or stop offering any part of the Service, including class types, schedules, locations, and features, at any time, temporarily or permanently. Speir will have no liability for any such change, except as required by law.

14. Indemnity

To the fullest extent permitted by law, you will defend and indemnify Speir and its owners, officers, directors, employees, instructors, contractors, affiliates, and agents (together, the "Speir Entities") against any third-party claim, and any related liability, damage, loss, and expense, including reasonable attorneys' fees and costs, arising out of or connected with: (a) your unauthorized use or misuse of the Service; (b) your violation of these Terms or any applicable law; (c) your violation of any third-party right, including intellectual property, publicity, confidentiality, property, or privacy rights; or (d) any dispute between you and a third party. We may, at our own expense, take exclusive control of the defense of any matter you must indemnify us for, and you agree to cooperate with our defense.

15. Disclaimers; No Warranties

THE SERVICE AND ALL MATERIALS AND CONTENT AVAILABLE THROUGH IT ARE PROVIDED "AS IS" AND "AS AVAILABLE." SPEIR DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING: (A) ANY IMPLIED WARRANTY OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, QUIET ENJOYMENT, OR NON-INFRINGEMENT; AND (B) ANY WARRANTY ARISING OUT OF COURSE OF DEALING, USAGE, OR TRADE. SPEIR DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR FREE OF ERRORS, VIRUSES, OR OTHER HARMFUL COMPONENTS, OR THAT ANY OF THOSE ISSUES WILL BE CORRECTED.

NO ADVICE OR INFORMATION, WHETHER ORAL OR WRITTEN, THAT YOU GET FROM THE SERVICE OR THE SPEIR ENTITIES WILL CREATE ANY WARRANTY NOT EXPRESSLY STATED IN THESE TERMS. YOU USE THE SERVICE AT YOUR OWN DISCRETION AND RISK. WE ARE NOT RESPONSIBLE FOR ANY DAMAGE TO YOUR PROPERTY (INCLUDING YOUR COMPUTER OR MOBILE DEVICE) OR ANY LOSS OF DATA, INCLUDING USER CONTENT.

THE LIMITATIONS, EXCLUSIONS, AND DISCLAIMERS IN THIS SECTION APPLY TO THE FULLEST EXTENT PERMITTED BY LAW. SPEIR DOES NOT DISCLAIM ANY WARRANTY OR OTHER RIGHT THAT THE LAW DOES NOT ALLOW IT TO DISCLAIM.

16. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, THE SPEIR ENTITIES WILL NOT BE LIABLE TO YOU FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES (INCLUDING LOSS OF PROFITS, GOODWILL, OR OTHER INTANGIBLE LOSS) ARISING OUT OF OR RELATING TO YOUR USE OF, OR INABILITY TO USE, THE SERVICE, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), STATUTE, OR ANY OTHER LEGAL THEORY, EVEN IF A SPEIR ENTITY HAS BEEN TOLD OF THE POSSIBILITY OF DAMAGE.

EXCEPT AS PROVIDED IN SECTION 18.5, AND TO THE FULLEST EXTENT PERMITTED BY LAW, THE TOTAL LIABILITY OF THE SPEIR ENTITIES TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS, WHETHER IN CONTRACT, TORT, OR OTHERWISE, IS LIMITED TO THE GREATER OF: (A) THE AMOUNT YOU PAID TO SPEIR FOR THE SERVICE IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM; OR (B) $100.

EACH PROVISION OF THESE TERMS THAT LIMITS LIABILITY, DISCLAIMS WARRANTIES, OR EXCLUDES DAMAGES ALLOCATES RISK BETWEEN THE PARTIES AND IS AN ESSENTIAL PART OF THE BARGAIN BETWEEN THEM. EACH OF THESE PROVISIONS IS SEVERABLE AND INDEPENDENT OF ALL OTHER PROVISIONS. THE LIMITATIONS IN THIS SECTION 16 APPLY EVEN IF ANY LIMITED REMEDY FAILS OF ITS ESSENTIAL PURPOSE. NOTHING IN THESE TERMS LIMITS LIABILITY THAT CANNOT BE LIMITED UNDER APPLICABLE LAW.

17. Governing Law

These Terms are governed by the laws of the State of California, without regard to its conflict of law rules. For any lawsuit or court proceeding permitted under these Terms, you and Speir agree to the personal and exclusive jurisdiction of the state and federal courts located in Los Angeles County, California.

18. Dispute Resolution and Arbitration

18.1 Generally. To resolve disputes quickly and cost-effectively, and except as described in Sections 18.2 and 18.3, you and Speir agree that every dispute arising out of or relating to these Terms or the Service will be resolved by binding arbitration. Arbitration is less formal than a lawsuit. It uses a neutral arbitrator instead of a judge or jury, may allow more limited discovery than court, and is subject to very limited review by courts. Arbitrators can award the same damages and relief that a court can. This agreement to arbitrate covers all claims, whether based in contract, tort, statute, fraud, misrepresentation, or any other legal theory, and whether the claim arises during or after these Terms end. YOU UNDERSTAND AND AGREE THAT, BY ENTERING INTO THESE TERMS, YOU AND SPEIR ARE EACH WAIVING THE RIGHT TO A TRIAL BY JURY OR TO PARTICIPATE IN A CLASS ACTION.

18.2 Exceptions. Nothing in these Terms waives or limits either party's right to: (a) bring an individual action in small claims court; (b) pursue an enforcement action through a federal, state, or local agency, if available; (c) seek injunctive relief in court in aid of arbitration; or (d) file suit in court over an intellectual property infringement claim.

18.3 Opt-Out. If you do not want to resolve disputes by binding arbitration, you may opt out of this Section 18 within 30 days after you first agree to these Terms. To opt out, send a letter to: Speir Pilates Holdings, LLC, Attention: Legal Department – Arbitration Opt-Out, 12821 Washington Blvd, Los Angeles, CA 90066. Your letter must include your full legal name, the email address on your account, and a statement that you want to opt out of arbitration ("Opt-Out Notice"). Once we receive your Opt-Out Notice, this Section 18 will not apply to you, and any dispute will be resolved as described in Section 17. The rest of these Terms will not be affected.

18.4 Arbitrator. Any arbitration will be governed by the Federal Arbitration Act and administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules ("AAA Rules"), as modified by these Terms. The AAA Rules and filing forms are available on the AAA website (adr.org), by calling the AAA at 1-800-778-7879, or by emailing us at hq@speirpilates.com. The arbitrator has exclusive authority to decide any dispute about the interpretation, applicability, or enforceability of this arbitration agreement.

18.5 Notice of Arbitration; Process. A party who wants to start arbitration must first send the other party a written notice of the dispute by certified U.S. Mail or FedEx (signature required), or, only if the other party has not provided a current physical address, by email ("Notice of Arbitration"). Speir's address for Notice of Arbitration is: Speir Pilates Holdings, LLC, 12821 Washington Blvd, Los Angeles, CA 90066. The Notice of Arbitration must: (a) describe the nature and basis of the claim; and (b) state the specific relief requested ("Demand"). The parties will try in good faith to resolve the claim directly. If they cannot within 30 days after the Notice of Arbitration is received, either party may start arbitration. All arbitration proceedings will be confidential unless both parties agree otherwise in writing. Neither party may tell the arbitrator the amount of any settlement offer until after the arbitrator makes a final decision and award, if any. If the arbitrator awards you more than Speir's last written settlement offer made before the award, Speir will pay you the greater of: (i) the amount awarded; or (ii) $10,000.

18.6 Fees. If you start arbitration under these Terms, Speir will reimburse your filing fee, unless your claim is for more than $10,000, in which case fees will be decided under the AAA Rules. Any hearing will take place at an agreed location in Los Angeles County, California. If your claim is for $10,000 or less, you may choose whether the arbitration will be conducted: (a) only on documents submitted to the arbitrator; (b) by telephone or video hearing; or (c) by an in-person hearing under the AAA Rules in the county of your billing address. If the arbitrator finds that your claim or the relief you requested is frivolous or brought for an improper purpose (under the standards of Federal Rule of Civil Procedure 11(b)), all fees will be governed by the AAA Rules, and you agree to reimburse Speir for any amounts it paid that you would otherwise owe under the AAA Rules. The arbitrator must issue a reasoned written decision explaining the essential findings and conclusions. The arbitrator may decide disputes about fees or expenses at any time during the proceeding, and on request from either party made within 14 days of the arbitrator's ruling on the merits.

18.7 No Class Actions. YOU AND SPEIR AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY CLASS OR REPRESENTATIVE PROCEEDING. Unless you and Speir both agree otherwise, the arbitrator may not combine more than one person's claims and may not preside over any form of class or representative proceeding.

18.8 Changes to This Arbitration Provision. If Speir changes this arbitration provision in the future (other than a change to Speir's address for Notice of Arbitration), you may reject the change by sending us written notice within 30 days of the change at the address for Notice of Arbitration. In that case, your account will be closed, and this arbitration provision, as it was before the change you rejected, will continue to apply.

18.9 Enforceability. If Section 18.7 or all of this Section 18 is found unenforceable, or if Speir receives an Opt-Out Notice from you, this entire Section 18 will be void, and the courts described in Section 17 will have exclusive jurisdiction over any dispute.

19. General Terms

19.1 Entire Agreement. These Terms, together with our Privacy Policy, our liability waiver, and any other terms expressly included by reference, are the entire agreement between you and Speir about the Service. You may not assign or transfer these Terms without our prior written consent. We may assign these Terms at any time without notice or consent. If we do not enforce any part of these Terms, that does not waive our right to enforce it later. Section headings are for convenience only. "Including" means "including but not limited to." If any part of these Terms is found invalid or unenforceable, that part will be enforced to the greatest extent possible, and the rest of these Terms will remain in effect.

19.2 Privacy Policy. Please read our Privacy Policy, available at speirpilates.com/privacy-policy and through the "Privacy Policy" link in the footer of our website, for information about how we collect, use, share, and protect your personal information. The Privacy Policy is part of these Terms.

19.3 Additional Terms. Your use of the Service is also subject to any additional terms, policies, or rules that we post for the Service or specific features, such as studio rules, promotion terms, and the policies on our Pricing page ("Additional Terms"). All Additional Terms are part of these Terms.

19.4 Electronic Communications. By using the Service, you agree to receive communications from us electronically. You agree that any notices, agreements, disclosures, or other communications we send you electronically satisfy any legal requirement that they be in writing.

19.5 Notice to California Residents. Under California Civil Code Section 1789.3, California residents may contact the Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs in writing at 1625 N. Market Blvd., Suite N-112, Sacramento, California 95834, or by phone at (800) 952-5210, to resolve a complaint about the Service or to get more information about using the Service.

19.6 Support. We are not required to provide technical support for the Service. Any support we offer is subject to our published policies.

19.7 International Use. The Service is intended for people located in the United States. We make no representation that it is appropriate or available for use outside the United States. Access to the Service from places where it is illegal is prohibited.

20. App Store Terms

20.1 Apple. This Section applies if you use the App on an Apple device. These Terms are between you and Speir only, not Apple Inc. ("Apple"), and Apple is not responsible for the App or its content. Apple has no obligation to provide maintenance or support for the App. If the App fails to meet any applicable warranty, you may notify Apple, and Apple will refund the purchase price of the App (if any) to you. To the maximum extent permitted by law, Apple has no other warranty obligation for the App. Apple is not responsible for addressing any claims by you or any third party relating to the App or your possession or use of it, including: (a) product liability claims; (b) any claim that the App fails to meet any legal or regulatory requirement; or (c) claims under consumer protection, privacy, or similar laws. Apple is not responsible for investigating, defending, settling, or discharging any third-party claim that the App or your possession and use of it infringes a third party's intellectual property rights. You agree to follow any applicable third-party terms when using the App. Apple and its subsidiaries are third-party beneficiaries of these Terms, and once you accept these Terms, Apple will have the right to enforce them against you as a third-party beneficiary. You represent that: (i) you are not located in a country subject to a U.S. Government embargo or designated by the U.S. Government as a "terrorist supporting" country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.

20.2 Google. This Section applies if you use the App on an Android device downloaded from Google Play. These Terms are between you and Speir only, not Google LLC ("Google"). Your use of the App must also comply with the Google Play Terms of Service. Google is not responsible for the App or its content and has no obligation to provide maintenance or support for it.
